In Bangalore, a rental security deposit is often several months' rent: lakhs of rupees in many cases. Getting it back is one of the most common sources of stress for tenants. Deductions for painting, cleaning and "damages" appear at the last minute, refunds are delayed for months, and some landlords simply stop answering calls.

Most deposit disputes are won or lost long before you move out, through what you sign, what you record and what you keep in writing. This guide covers what to do at each stage, and the steps to take if the landlord still won't pay.

The plan in brief

  • At move-in: a clear refund clause in the agreement, the deposit paid by bank transfer, and dated photos of the flat.
  • Before moving out: written notice, settled bills, small repairs, and a cleaned flat.
  • At handover: a joint walkthrough and a signed handover note.
  • If it isn't refunded: written reminders, then a demand letter, a lawyer's notice, mediation, and finally a civil suit (generally within 3 years).

1. Why deposits get stuck

2. It starts at move-in

3. During the tenancy

4. Before you move out

  1. Give notice in writing as the agreement requires, and check any lock-in period.
  2. Ask the landlord in writing for the refund date and any deductions they expect. It's much easier to settle disagreements before handover than after.
  3. Fix small things: replace fused bulbs, fill nail holes if you made them, and repair anything you broke.
  4. Clean the flat thoroughly, or hire a cleaning service and keep the bill, to avoid a large cleaning deduction.
  5. Settle every bill (electricity, water and society maintenance) up to your move-out date, and keep receipts. Photograph the final meter reading.
  6. Get the society's move-out clearance if it requires one. See our home shifting checklist.

5. Handover day

6. Fair and unfair deductions

A landlord is entitled to recover genuine losses, but not to make a profit from your deposit.

Usually fair Usually unfair
Unpaid rent, or rent for an unserved notice periodNormal wear and tear: faded paint, minor scuffs, ageing fixtures
Unpaid electricity, water or maintenance billsRound-figure "repair" or "painting" charges with no bills
Damage beyond normal use, such as broken tiles or a damaged applianceRepainting the whole flat when the agreement doesn't provide for it
Missing items from the inventoryRepairs to problems you reported in writing during the tenancy
Painting or cleaning at actual cost, if the agreement says soHolding back the entire deposit for a small issue

For any deduction you disagree with, ask in writing for an itemised list with bills or quotations. Many inflated deductions disappear once a landlord is asked to justify them.

7. Adjusting the deposit against the last month's rent

Many Bangalore tenants stop paying rent for the last month or two and tell the landlord to "adjust it from the deposit". It is common, but it is a breach of the agreement unless the landlord agrees. It can also turn a simple refund into a dispute over unpaid rent and damages. If you want to do it, get the landlord's agreement in writing first.

8. If the landlord delays or refuses

Move step by step, and keep everything in writing.

  1. Polite written reminders. Send messages or emails stating the amount and the agreed refund date. Calls leave no record.
  2. A formal demand letter. Send it yourself, by email and by registered post or speed post, stating the amount, the facts and a deadline, such as 15 days (see the sample below).
  3. A lawyer's legal notice. A notice on an advocate's letterhead is often enough to get the money back. It also fixes the date of your demand, which helps if you go to court.
  4. Mediation or Lok Adalat. Ask the District Legal Services Authority in Bengaluru about pre-litigation mediation, or about Lok Adalat sittings, where disputes can be settled with the landlord's agreement at little or no cost.
  5. A civil suit for recovery. If nothing else works, file a suit to recover the money, generally in the court for the area where the flat is. A lawyer may advise a summary suit, a quicker procedure for money claims based on a written contract. You can also claim interest.

Know the limits.

  • Time limit: a suit to recover money generally has to be filed within three years (Limitation Act, 1963), usually counted from when the refund was due or demanded. Don't wait.
  • Consumer forums: a dispute with a private individual landlord is generally treated as a civil matter, not a consumer complaint. A consumer complaint may be possible against a company that held your deposit, such as a co-living or managed-rental operator, or a broker.
  • Police: a deposit dispute is normally a civil matter. If you were cheated from the start, for example by someone who wasn't the real owner, or the landlord has disappeared with the money, file a police complaint as well.

9. Sample demand letter

Adapt this to your situation, and send it by email and registered post or speed post. Keep the proof of sending.

Frequently asked questions

How long does a landlord have to return the deposit?

Whatever your rent agreement says. That is why the refund date should be written into it. If the agreement is silent, the refund should be made within a reasonable time after handover, and you should agree on a specific date in writing at the time of moving out.

Can the landlord deduct painting charges?

Only if the agreement allows it, and the amount should be reasonable and supported by bills. Many Bangalore agreements include a painting clause, which is why it pays to negotiate it at the start.

Can I file a consumer complaint against my landlord?

Generally not against a private individual landlord, because that is treated as a civil dispute. It may be possible against a company that provided the accommodation and held your deposit. Ask a lawyer about your case.

Is there a time limit to recover my deposit?

Yes. A civil suit to recover money must generally be filed within three years, usually counted from when the refund became due or was demanded.

Is there a legal limit on how much deposit a landlord can take?

No clear legal cap applies in Karnataka today, so the amount is negotiated. See our rental agreement guide for the current law and common misinformation.
